Terms of service
These terms govern purchases and use of Pop the Gift. By buying or publishing a gift, you agree to them.
Effective August 31, 2026Who may use Pop the Gift
You must be at least 18 years old, or the age of majority where you live, to make a purchase. You are responsible for anyone who uses your device, gift link or private gift-pass code.
Your content and permission
You keep ownership of content you submit. You give Pop the Gift a limited, non-exclusive permission to host, process, reproduce and display that content only as needed to create, deliver, protect and support your gift. You confirm that you have permission to upload and share every photo, recording, file, link and message you submit.
Private links, expiration and credits
Gift links are unlisted but are not password-protected. Anyone with the complete link may be able to view the gift. Unpaid checkout drafts expire after 90 days. Paid gift links expire after 12 months without a successful open; each successful open resets that 12-month period. Link access stops immediately at expiration. Purchased gift credits do not expire.
Payments
Prices are shown before checkout and payment is processed by Stripe. You authorize the displayed charge and agree to provide accurate payment information. Taxes may be added when required. Refund eligibility is described in our Refund Policy.
Acceptable use
You may not use Pop the Gift for unlawful, fraudulent, threatening, harassing, exploitative, infringing or malicious content, or to distribute malware, impersonate another person or expose someone’s private information without permission. The complete rules appear in our Acceptable Use Policy.
Availability and changes
We work to keep gifts available through the stated link period, but internet services can experience interruptions. We may modify, suspend or discontinue features, and may remove content or disable links when reasonably necessary to protect users, comply with law or enforce these terms.
Disclaimers and liability
To the extent permitted by law, Pop the Gift is provided “as is” and without warranties of uninterrupted or error-free operation. We are not responsible for third-party links, recipient actions or content supplied by users. To the extent permitted by law, our total liability for a claim relating to a purchase will not exceed the amount you paid for the affected product. Nothing here limits rights that cannot legally be limited.
Governing law and contact
These terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. Email hello@popthegift.com.
